Please read carefully before participating. This is a release of legal rights. By signing up for or taking part in any Quincy Pickleball League activity, you agree to the terms below — for yourself and for anyone you bring with you. Participation is limited to adults 18 years of age or older.
In this document, “the League” means Quincy Pickleball League (also known as Quincy Pickle) and its organizers, volunteers, coordinators, hosts, sponsors, and anyone acting on its behalf. “Activities” means open play sessions, games, practices, clinics, social events, and any related activity organized or promoted by the League, including travel to and from them. “I” and “me” mean the adult participant signing this waiver. “Guest” means any person I bring to, invite to, or am accompanied by at the Activities — whether they play, watch, or are simply present — including a friend, family member, partner, spectator, or child in my care.
1. Assumption of risk
I understand that pickleball is a physical, athletic activity that carries inherent risks of injury, illness, permanent disability, property damage, and death. These risks include, but are not limited to: falls, slips, and collisions with other players, paddles, balls, nets, fencing, or court surfaces; sprains, strains, fractures, cuts, concussions, dental and eye injuries; heat exhaustion, dehydration, heart attack, stroke, and other medical conditions; uneven, wet, or otherwise hazardous court conditions; weather; the actions or inaction of other participants, spectators, or third parties; and exposure to communicable illness.
I understand these risks cannot be eliminated regardless of the care taken to avoid them. I am voluntarily choosing to participate, and I knowingly and freely assume all such risks, both known and unknown, whether caused by the ordinary negligence of the League or otherwise.
2. Eligibility — adults only
Participation in the Activities is limited to individuals who are 18 years of age or older. I represent that I am at least 18 years old. The League does not accept minors as participants, does not supervise children, and cannot accept a waiver signed by a parent or guardian on a minor’s behalf. Anyone under 18 who is present at the courts remains the sole responsibility of the adult who brought them and may not take part in play.
3. Guests I bring
Bringing someone with me is my decision and my responsibility. I remain responsible for my Guests for as long as they are at the Activities, whether they play or not, and I agree that:
- I accept full responsibility for my Guests’ safety, supervision, and conduct at the Activities, and I assume on their behalf all of the risks described in Section 1. Any Guest who takes part in play must be 18 years of age or older.
- I will make my Guests aware, before they arrive or play, that this waiver and the League’s rules of play and conduct apply to them, and that they take part at their own risk.
- The release in Section 5 and the indemnity in Section 6 extend to any claim arising out of a Guest’s presence at or participation in the Activities — including a claim brought by the Guest, brought on the Guest’s behalf, or brought by anyone claiming through them — and I will defend and hold the Released Parties harmless from any such claim.
- I am responsible for any injury, loss, or damage my Guests cause to another participant, to the facilities, or to anyone else’s property.
I understand that the League runs its sessions at a public park, does not control who else is present, and makes no promise of space, court time, or supervision for Guests. The League may ask a Guest to leave for the same reasons it may ask a participant to leave.
4. Fitness to participate
I represent that I am physically fit and have no medical condition that would prevent my safe participation. I understand that the League does not provide medical evaluation, athletic training, or on-site medical personnel, and that I am responsible for consulting a physician before participating. I agree to stop participating and seek medical attention if I experience pain, discomfort, or symptoms of injury or illness.
5. Release and waiver of claims
In consideration of being permitted to participate in the Activities, I hereby release, waive, discharge, and covenant not to sue the League — and, to the extent applicable, the City of Quincy, Massachusetts, the Quincy Park Department, and any other owner or operator of the facilities used, together with their officials, employees, agents, and volunteers (collectively, the “Released Parties”) — from any and all claims, demands, losses, liabilities, actions, and causes of action for any injury, illness, disability, death, or loss of or damage to property that I may suffer arising out of or related to my participation in the Activities, whether caused by the ordinary negligence of the Released Parties or otherwise, to the fullest extent permitted by law.
I understand that this release does not apply to conduct that is grossly negligent, reckless, intentional, or otherwise not releasable under Massachusetts law.
6. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from any loss, liability, damage, or cost, including reasonable attorneys’ fees, that they may incur as a result of my participation in the Activities, or the presence or participation of any Guest I bring, or arising from any claim brought by me, by a Guest, or on either of our behalves, including a claim brought by a third party for injury or damage that I or a Guest cause.
7. Medical treatment
I authorize the League to arrange emergency medical care, transportation, or first aid on my behalf if I am injured and unable to consent. I understand that I am financially responsible for the cost of any such care, and that the League carries no medical, accident, or health insurance covering participants. I am responsible for maintaining my own health insurance.
8. Rules and conduct
I agree to follow the rules of play, the paddle-rack queue, posted facility rules, and any instructions given by the League’s organizers. I agree to treat other players, neighbors, and park users with respect. I understand the League may ask me to leave or may end my participation at any time for conduct that is unsafe, disruptive, or disrespectful.
9. Personal property
I understand that the courts are a public facility and that the League is not responsible for loss of, theft of, or damage to paddles, phones, bags, vehicles, or any other personal property I bring to the Activities.
10. Governing law and severability
This waiver is governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules. Any dispute arising under it shall be brought in the state or federal courts located in Norfolk County, Massachusetts. If any provision of this waiver is held invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be enforced to the greatest extent permitted by law.
11. Acknowledgment
I have read this Release of Liability, Waiver of Claims, and Assumption of Risk. I understand that I am giving up substantial legal rights, including the right to sue. I confirm that I am signing it freely and voluntarily, without inducement, and that I am at least 18 years of age and legally competent to sign it. I am signing on my own behalf and on behalf of any Guest I bring. I agree that submitting the League’s sign-up form, or checking the box that references this page, constitutes my electronic signature and has the same legal effect as a handwritten signature.
